    This is an ignorant and disgusting accusation, completely lacking in any support regarding where the anonymous poster supposedly heard Bernadette say the things she is accuse of saying; but it does not meet the requirements for a case of slander. In New Jersey, four elements are necessary to support an action for slander. The most obvious missing element is the fourth one: Bernadette has not suffered any compensable damages from this. In a slander case, hurt feelings do not amount to damages. Usually, there must be economic damage to support a slander case, though I'm not sure whether that is true in New Jersey. But at the very least, there must be proof that people believed the false statement, to the victim's detriment.

    You might say that's unfair. But before you do that, think about how clogged our courts would be if every incident of name-calling ended up in the courts. Our tax dollars shouldn't go to support that.

    Second, name-calling is not slander either. That is classified as an opinion or conclusion, not a statement of fact. Slander is based on one or more false statements of fact.

    In this case, the only "factual" accusation being made is that Bernadette supposedly used a racially offensive word. Whether she did or did not, it's unlikely that the other elements of the claim can be supported, if that's the only fact claim made in the accusation.

    Thank you for your post and link. KOTW has updated the initial post to include a more detailed note indicating that the initial post was allowed because Bernadette McDonald is an elected official and that the statement may be false.

    During elections many things are said about candidates and their supporters. Not all of them are true but if you are running for office and/or an elected official they come with the job.

    I just finished reading UNDER PRESSURE by Ray Lucas. The Book was easy to Read . Ray came across as very sincere and very Humble . I bought the Book to be Supportive of Local Guy and ended up really enjoying it. The Book will take some of you down Memory lane in Harrison HS Football . " The Pit " The Falivene Bros . and Ralph Borgess . ( Ray never mentioned Borgess yelling "You Sausage ")

    The puzzles are to keep the spammers at bay. They work wonderfully. You don't need to be perfect in your placement. Close wins the prize. Unless you want to volunteer to delete the spammers who were flooding the board and pay us a million dollars so we can retire, the puzzles are here to stay.

  15. Will Kearny have a "Christmas Tree" this year ?

    Nope! I don't believe all guests are the same person! That would mean that mostly one person would be arguing both points of view. "Now that's funny" no I believe a large majority of the anti Christmas posts are being written by the same person. I come to this conclusion by noticing a similar writing, vocabulary, grammar and punctuation! Not that I am any kind of expert in any of those areas. Just my humble opinion! And who knows maybe its KOTW trying to boost the topic. Merry Christmas!

    KOTW tries to stay out of making comments. KOTW violated its own guideline by posting "Now that's funny". It was not because the posters comment was necessarily true but that it was something KOTW had never thought of in the years we have been running the Discussion Board. It was a possibility and the thought of it was funny.

    KOTW purpose is to allow an open discussion of issues. It is best not to get involved in those discussions and simply sit back and allow the discussion to evolve and let each person express their opinion.

    Kuehne Still Dangerous, a new article on our front page.

    It's been almost 10 years since the Kearny Kuehne plant was identified as a potential disaster. It would be interesting to find out what measures have been taken to protect citizens from a potential terrorists attack or a simple accident at the plant?

    This thread goes back to November 2003. Does anyone think anything will change? Are we waiting for our house to be robbed before we install a lock on our front door?

    What are your thoughts on Kuehne?
