I love the quote from Santos on this.  A "generous policy", I'm fairly certain the per diem money of which he speaks is off limits to the employer under USERRA rules.  So the Town of Kearny is generously abiding by a Federal law.

The whole point of the story was that after the first 30 days of leave during which the employee/soldier receives 2 paychecks, the city has no obligation to pay anything, wasn't it? But yet most cities including Kearny and the State of New Jersey continuing most of the employee salary by only deducting the military pay.

I'm curious about the rules you mention. In addition to base pay, there are several "allowances" including a "Personal Money Allowance" that the US military pays. Are all of the allowances covered by the USERRA rules? Can you post them?
