A "generous policy", I'm fairly certain the per diem money of which he speaks is off limits to the employer under USERRA rules. So the Town of Kearny is generously abiding by a Federal law. The fire chief unceremoniously and unexpectedly retired from his job last year – no one really knew why. Now, two firefighters file suit against the fire department and the town, both alleging that “top fire brass” harassed them. But yet most cities including Kearny and the State of New Jersey continuing most of the employee salary by only deducting the military pay. I'm curious about the rules you mention. In addition to base pay, there are several "allowances" including a "Personal Money Allowance" that the US military pays. Are all of the allowances covered by the USERRA rules? Can you post them?
