No, you have it backwards. It's a PRIVATELY OWNED bar that is open to the public. Therefore it is up to the owner to decide wheter or not to allow smoking. Not you or anyone else. It may be privately owned, but it relies on the public for its survival and it doesn't mean you, or the owner, get to make the rules. Sure it does. just as the owner reserves the right refuse service if they choose or to allow someone to smoke or not to smoke. Topless bars rely on the public as well and those who individuals who don't want to see topless women don't go in there but in turn they don't make illegal for others. Same with smoking. If a bar or restaurant allows smoking and you don't like it, don't go there. Yes, it is that simple. In today's environment there would plenty of other to places that don't allow smoking as a choice for thier business. Seems as if everyone gets to make a choice but the smoker.
