It's not a matter of "Toughness" it's a matter of legalities. By holding the trial in NYC, you are handing several lines of appeal to the defense attorneys on a gold-plated platter.

#1. Finding a Fair, and Impartial Jury. Unless they restrict it to people who have moved into the area in the last 8 years you will NOT find anyone who was not affected directly or indirectly by the 9-11 attacks in the Southern District of NY.

#2. The close proximity of the courthouse to Ground Zero. gaian, it gives the Defense Team a softball to say that the Jury was predjudiced by the mere presnece of Ground Zero that is X number of yards away from where the trial was held.

#3. The increased security that will be present, which will be readily apparent to anyone serving on the jury..again will be argued by the Defense team that it predjudiced the jury against the defendants.

The SMART thing to do, would have been to hold this Trial in Kansas, or somewhere else out in the midwest, where your Jury wont have the strong personal ties to the event, and the resulting media Circus wont Gridlock America's largest city EVERY DAMN DAY for months on end.

So, imagine if a judge says: "These men weren't read their Miranda rights, let them go."? I would argue that as non-citizens, they don't have these rights, but can you be so sure this wouldn't happen. In this instance there isn't even a trial, that's the end, game over.

True enough, New Yorkers are tough, and will handle this like many other tribulations that they face. My question is, do you believe that someone caught ON THE BATTLEFIELD is a law enforcement issue? I don't. A military tribunal is exactly where I expect a "soldier of Allah" to be tried. Fair trial, yes; jury of his peers, NO! How do you afford the rights of this great country to a man who holds our values in disdain.

A trial in a US court grants KSM the forum to indict this country in a very public forum, and I don't think we should allow it. But, the decision has been made, and time will tell if it is the US at its greatest virtue, or a silver plattered invitation to join the Jihad.

Incidentally, when they brought Ramzi Youssef back to this country for trial, in a helicopter overlooking the Twin Towers, he is said to have said, the next time they won't be standing. Such was his fear of our criminal justice system.

It's not a matter of "Toughness" it's a matter of legalities. By holding the trial in NYC, you are handing several lines of appeal to the defense attorneys on a gold-plated platter.

#1. Finding a Fair, and Impartial Jury. Unless they restrict it to people who have moved into the area in the last 8 years you will NOT find anyone who was not affected directly or indirectly by the 9-11 attacks in the Southern District of NY.

#2. The close proximity of the courthouse to Ground Zero. gaian, it gives the Defense Team a softball to say that the Jury was predjudiced by the mere presnece of Ground Zero that is X number of yards away from where the trial was held.

#3. The increased security that will be present, which will be readily apparent to anyone serving on the jury..again will be argued by the Defense team that it predjudiced the jury against the defendants.

The SMART thing to do, would have been to hold this Trial in Kansas, or somewhere else out in the midwest, where your Jury wont have the strong personal ties to the event, and the resulting media Circus wont Gridlock America's largest city EVERY DAMN DAY for months on end.

Then it will be up to the Defendant to move for a change of venue. If he does, maybe it will be granted. If he doesn't, he waives his right and we don't have to worry about it.

The decision to try the 9-11 suspects in NYC was made entirely by Eric Holder, the Attorney General. The President, by HOLDER's own statement had no role in that decision. It was a STUPID decision on the part of Holder, not Obama. I Tried to write that in crayon so you could understand it KO, but that just isnt an option.
